Maryland Law Opens a New Route for Surplus Pet Food to Reach Animals
A first-of-its-kind Maryland law is removing a legal obstacle that can prevent safe, usable pet food and supplies from reaching animals in need.

Senate Bill 314, now Chapter 464, took effect October 1. The law provides civil-liability protection when a person or business donates qualifying pet supplies in good faith to a nonprofit or state or local government agency. It also protects organizations distributing donated items on their behalf.

The protection is not unconditional. A donated item must appear fit for use and comply with applicable federal, state and local quality and labeling requirements. Immunity does not cover gross negligence or willful and wanton misconduct. The Maryland Department of Agriculture may inspect donated commercial feed for wholesomeness and establish handling procedures. SB0314

The measure passed both legislative chambers unanimously before receiving the governor’s approval on May 12.

Humane World for Animals announced the law’s implementation on October 13, describing Maryland as the first state to enact this particular protection for pet-supply donations. The organization says the change could help manufacturers, distributors and retailers donate overstocked products, discontinued items, older packaging and goods with harmless outer-package damage instead of discarding them. Shelters, rescue groups and pet-food pantries can use those donations to stretch limited budgets. Families struggling to afford food for their animals may also receive help through participating community organizations.
The law does not require businesses to donate, guarantee a particular volume of supplies or permit unsafe products to be distributed. Its practical impact will depend on whether animal organizations build partnerships with retailers and manufacturers.
Still, Maryland has created a concrete pathway for suitable surplus goods to support animals rather than become waste.
